Depuy Hip Recall Lawyers Note Recent Settlement

Depuy Hip Recall LawyersDePuy hip recall lawyers note a November 12, 2013 news article from Reuters reporting that Johnson & Johnson has agreed to pay $4 billion to settle thousands of lawsuits filed due to alleged defects with its ASR metal on metal hip replacement systems.  According to the article:

“DePuy recalled thousands of its metal ASR hip systems due to higher-than-expected failure rates. Plaintiffs claim that defective metal-on-metal devices caused pain, discomfort and more serious complications, including increased levels of metal ions in the bloodstream.   The devices were introduced in the United States in 2005, and DePuy recalled the product in 2010 after selling an estimated 93,000 units worldwide. Data from the UK at the time showed that about 12 percent of the implants needed to be replaced after five years.”

DePuy hip recall lawyers have previously noted the risks associated with metal on metal hip replacements, including metallosis from chromium and cobalt infiltrating the blood stream, which can lead to neurological damage, as well as pain, swelling, limited mobility and device failures. In March 2013, it was reported that a jury in California awarded $8.3 million to a man after finding that his DePuy ASR XL hip replacement system was defectively designed.  This was the first of approximately 11,000 hip replacement lawsuits against DePuy to go to trial.  A subsequent trial against DePuy in Illinois resulted in a verdict for Johnson & Johnson, and other bellwether trials scheduled for this fall have either settled individually or were postponed, possibly in order to facilitate global settlement discussions that appear to have come to fruition based on the Reuters report.

Settlement Will Most Likely Not Prevent Future Claims

Whereas specific terms of the settlement were not disclosed in the Reuters report, DePuy hip recall lawyers note that often global settlements like the one entered into by Johnson & Johnson often make provision for claims not yet brought by patients who have been injured as a result of the allegedly defective product. Accordingly, DePuy hip recall patients should know that a settlement of existing claims most likely will NOT affect your ability to bring claims in the future, although conditions of the settlement or state statute of limitation laws may limit the time in which you have to bring a claim.  Accordingly, it is important that you consult with DePuy hip recall lawyers AS SOON AS POSSIBLE in order to explore your legal options in the wake of the Johnson & Johnson DePuy ASR settlement.  Patients are advised to not deal with the company directly regarding their claims without consulting Depuy hip recall lawyers for advice on their legal rights.
