Depuy Lawsuits: Depuy Sued For Faulty Prosthetic Device

Although DePuy Othopaedics is currently facing lawsuits across the country from plaintiffs who have allegedly sustained injuries due to the company’s hip replacement products, the manufacturer is facing lawsuits involving other products as well. According to court documents, the most recent of DePuy lawsuits includes one filed on behalf of a Michiana woman who claims that the Agility Total Ankle System, a prosthetic device, was defective and caused her to experience significant pain.
According to the DePuy lawsuit, Johnson & Johnson, DePuy’s parent company, and DePuy itself are accused of designing, manufacturing and marketing a defective product, and that components of the prosthetic device had not yet received approval from the U.S. Food and Drug Administration. The plaintiff also alleges that several of the device’s metal components are high conductors of electricity and heat, and neither she nor her doctors were made aware of this fact prior to implantation. She is suing Johnson & Johnson and DePuy for breach of express warranty, breach of merchantability and negligence.
DePuy Lawsuits Allege Faulty Hip Implants
While the most recent of the DePuy lawsuits focuses on a prosthetic device, the manufacturer is also facing thousands of lawsuits filed by plaintiffs who have allegedly sustained injuries after receiving the company’s ASR and Pinnacle hip implant devices.
Court documents indicate that more than 10,000 ASR recall lawsuits have been filed, and more than 3,000 Pinnacle hip claims are pending in courts throughout the U.S. Plaintiffs allege that these devices were defectively designed and caused recipients to experience adverse side effects and life-threatening complications including metal poisoning, and many have reportedly needed revision or removal procedures to correct the problems caused by the implants.
Manufacturers have a responsibility to ensure that the products they release to consumers are relatively safe and free of known dangers. Whether the products are prosthetic devices, hip implants, cribs or lamps, when a manufacturer introduces a product that causes injury or harm, it should be held responsible for unsafe products. Those who have been injured may be eligible to seek compensation for damages.
